1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Silvanta" / "We" / "Our" — the senior living residence operating at 5 Moo 3, Nong Kae, Hua Hin, Prachuap Khiri Khan 77110, Thailand.
• "Resident" — an individual who has entered into a residency arrangement with Silvanta.
• "Enquirer" / "User" — any individual who accesses our website or contacts us without yet being a resident.
• "Services" — the senior living accommodation and associated community services provided by Silvanta.
• "Agreement" — the residency arrangement confirmed between Silvanta and the Resident or their authorised representative.

2. Acceptance of Terms

By using our website, submitting an enquiry, or entering into a residency arrangement, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

Residents must be aged 18 or above, or represented by a legally authorised adult. Silvanta reserves the right to verify eligibility before confirming any residency arrangement.

3. Service Description

Silvanta provides non-medical senior living residency services, including private accommodation, daily meals, housekeeping, laundry, community activities, and continuous staff presence. Full details of each residency option are described on our website and confirmed in writing at the time of arrangement.

Silvanta is not a medical, nursing, or clinical care facility. We do not provide medical treatment, diagnosis, or clinical support services.

4. Residency Arrangements

Residency arrangements are confirmed in writing and specify the residency type, duration, fees, and included services. The following applies:

• The Trial Residence Experience is a two-week arrangement and is not renewable as a trial.
• Standard and Premium residency arrangements are monthly and continue until terminated by either party with notice as specified in the written agreement.
• Silvanta reserves the right to decline or end a residency arrangement where circumstances make continued residency unsuitable for the individual or the community.

5. Payment Terms

All fees are quoted and payable in Thai Baht (฿). Payment is due in advance of the relevant period. Accepted payment methods are confirmed at the time of arrangement.

For the Trial Residence Experience: full payment is due prior to the start of the stay.

For monthly residencies: payment is due on or before the first day of each month. Late payment may result in a written notice and, if unresolved, review of the residency arrangement.

6. Cancellation and Refund

For the Trial Residence Experience: cancellation made more than 7 days before the start date will receive a full refund. Cancellation within 7 days of the start date is non-refundable.

For monthly residencies: notice of departure is required in advance as specified in the written residency agreement. Fees for periods already paid and services already used are not refunded.

7. Resident Responsibilities

Residents agree to:

• Treat fellow residents and staff with respect at all times
• Comply with reasonable community guidelines provided at admission
• Keep Silvanta informed of any changes relevant to their care arrangement
• Not undertake activities on the premises that endanger others

8. Intellectual Property

All website content, including text, images, and design, is the property of Silvanta. Reproduction or use without prior written permission is not permitted.

9. Disclaimers

Silvanta provides its services with care and attention, but does not guarantee specific outcomes related to a resident's health, wellbeing, or personal circumstances beyond the scope of the services described. Website content is provided for informational purposes only and does not constitute professional advice of any kind.

10. Limitation of Liability

To the extent permitted by Thai law, Silvanta's liability for any claim arising from these terms or the use of our services is limited to the fees paid for the relevant residency period. We are not liable for indirect or consequential losses.

11. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from these terms will first be addressed through direct communication. If unresolved, the matter will be referred to the courts of Prachuap Khiri Khan Province, Thailand.

12. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be communicated on this page with an updated effective date. Continued use of our services constitutes acceptance of revised terms.
